TERMS & CONDITIONS — CIRALLE (CANADA)

  1. DEFINITIONS
    “Ciralle”, “we”, “us” and “our” mean MPM-Group VOF (The Netherlands), trading as Ciralle. “Customer”, “you” and “your” mean a consumer purchasing for personal use. “Website” means ciralle.com and any related channels. “Business Day” means Monday–Friday, excluding public holidays at our fulfillment or support locations.

Note: We currently deliver to all Canadian provinces and territories except Québec until a French version and Québec language requirements are in place.

  1. SCOPE & ACCEPTANCE
    These Terms apply to every offer, order, and distance contract concluded through the Website. By placing an order, you agree to these Terms and to our Returns Policy and Privacy Policy (which form part of the contract). A printable copy of these Terms is available on the Website.

  2. PRODUCTS, IMAGES & AVAILABILITY
    We aim to describe items accurately. Minor differences in colour/fit may occur due to screen settings or manufacturing tolerances. If an item becomes unavailable after you order, we will notify you and refund or propose an alternative.

  3. PRICING, NO DRIP PRICING, TAXES & DUTIES
    5.1 No drip pricing. Advertised prices include all non-optional fees we charge. We do not add hidden mandatory fees at checkout.
    5.2 Currency. Prices are shown in Canadian dollars (CAD).
    5.3 Sales taxes. Where we are required or registered to collect Canadian sales taxes, applicable GST/HST and any PST/QST are displayed at checkout based on the delivery address. Where we are not required or registered to collect taxes, taxes and/or import duties may be payable upon delivery to the carrier or customs authorities. We disclose this before you place your order.
    5.4 Shipping. Standard shipping is free on all orders (see Section 8).
    5.5 Pricing errors. We may correct obvious pricing errors. If we cancel for a manifest error, you will receive a full refund.

  4. ORDERING & CONTRACT FORMATION
    Your order is an offer to buy. The contract is formed when we email the order confirmation. We may decline or cancel an order (for example, suspected fraud, delivery restrictions, or pricing error). You must provide accurate shipping, billing, and contact details.

  5. PAYMENTS (SHOPIFY CHECKOUT)
    Accepted online payment methods (subject to availability): Visa, Mastercard, American Express, Discover via Shopify Payments; accelerated checkouts Shop Pay, Apple Pay, Google Pay; PayPal Express; and Shop Pay Installments (buy-now-pay-later) where available. Payment is captured at checkout. Refunds are issued to the original payment method.

  6. SHIPPING, DELIVERY & RISK (STANDARD SERVICE ONLY)
    8.1 Origin. Orders ship from our overseas suppliers (e.g., China) to Canadian addresses using standard international postal services. We do not offer express shipping.
    8.2 Processing time. 1–2 Business Days.
    8.3 Delivery estimates (standard). Typical transit time is about 10–20 Business Days (approximately 2–4 weeks). Economy/surface options may take 4–12 weeks. Delivery standards are estimates, not guarantees, and may vary due to destination, seasonality, customs clearance, or carrier constraints.
    8.4 Carriers. Export leg via origin-country postal operator (e.g., China Post); hand-off to Canada Post on arrival.
    8.5 Risk and title. Risk of loss and title pass on delivery to your address or to a person designated by you.
    8.6 Delays. If we cannot ship within the indicated or legally required timeframe, you may cancel the order and receive a full refund, subject to applicable provincial consumer laws.
    8.7 Tracking. Tracking may be limited on some services until the parcel is processed in Canada.

  7. RETURNS, EXCHANGES & STATUTORY RIGHTS
    9.1 Ciralle commercial returns policy. You may return unused items within 14 days of delivery for a refund or store credit.
    9.2 Condition. Items must be unused, unwashed, and returned with original tags and packaging.
    9.3 Exclusions. For hygiene or final-sale reasons, the following are not returnable unless defective or required by law: intimates/lingerie, swimwear, earrings, customized/monogrammed items, gift cards, and items marked “final sale”.
    9.4 Return costs. Return shipping costs are paid by the customer.
    9.5 Process. Email info@ciralle.com within 14 days of delivery with your order number. We will provide an RMA and return instructions, including the return address.
    9.6 Refund timing. Refunds are processed within 14 Business Days after we receive and inspect the return, to the original payment method (or store credit if you choose).
    9.7 Exchanges. Exchanges are available if stock permits; otherwise, we issue a refund or store credit.
    9.8 Statutory rights. Provincial consumer protection laws may grant additional rights (for example, where required pre-contract disclosures were missing or delivery deadlines were not met). Those rights apply as mandated by law.

  8. DEFECTS & WARRANTY
    If an item is defective or not as described, contact info@ciralle.com with your order number and clear photos. We will repair, replace, or refund in accordance with applicable law and our policies.

  9. PROMOTIONS & DISCOUNT CODES
    One code per order unless otherwise stated. Codes have no cash value, are non-transferable, and may exclude sale/final-sale items and gift cards. Promotions may be withdrawn where permitted by law.

  10. USER-GENERATED CONTENT (UGC) & REVIEWS
    By submitting or tagging content featuring our products (e.g., using #Ciralle or tagging @Ciralle), you grant Ciralle a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in our online and offline marketing, subject to your privacy rights and the terms of the relevant platforms. You may revoke this licence prospectively by emailing info@ciralle.com.

  11. COMMUNICATIONS & ANTI-SPAM (CASL)
    We send commercial electronic messages only with your consent, including clear sender identification and a working unsubscribe link in each message. See our Privacy Policy for details.

  12. CUSTOMER SERVICE & COMPLAINTS
    We aim to respond to customer service emails within 2 Business Days. Contact: info@ciralle.com. If a resolution is not possible, you may have additional rights under the consumer laws of your province or territory.

  13. GOVERNING LAW & JURISDICTION
    These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Mandatory consumer protection laws of your province or territory of residence also apply. Disputes are subject to the courts of Ontario unless a different forum is required by mandatory law.

  14. LANGUAGE & QUÉBEC
    These Terms are available in English. We do not currently deliver to Québec until a French version is available and Québec language requirements are met.

  15. INTELLECTUAL PROPERTY
    All trademarks (including CIRALLE) and content on the Website are owned by or licensed to Ciralle. You may not copy, reproduce, or use them without our prior written permission.

  16. LIABILITY
    To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your order or use of the Website. Nothing in these Terms excludes or limits liability that cannot be excluded by law.

  17. CHANGES TO THESE TERMS
    We may update these Terms from time to time. The version effective at the time you place your order applies to that order. A printable copy will be provided upon request.

  18. FORCE MAJEURE
    We are not responsible for any failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, epidemics, war, labour disputes, carrier or customs delays, or failures of telecommunications or internet services.

  19. SEVERABILITY & ASSIGNMENT
    If a provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect. You may not assign your rights or obligations without our prior written consent; we may assign these Terms to an affiliate or successor in interest where permitted by law.
